JUSTICE COURT OF RIGHT TO LIFE
Phydios v. Stellonia

Phydios v. Stellonia
Decided November 27, 2015
THE REPUBLIC OF PHYDIOS,
Plaintiff, representing himself,
v.
THE FEDERATED STATES OF STELLONIA,
Defendant, representing himself.
On November 23, 2015, Phydios sued Stellonia for voting against a proposal to repeal the NationStates General Assembly resolution "Reproductive Freedoms." He argued that Stellonia, by his vote, unlawfully had taken a pro-abortion stance and, therefore, should be deprived of regional citizenship.
NEW DOLGARIA, JP, delivered the opinion of the Justice Court.
I agree with Phydios' reasoning that Reproductive Freedoms is clearly talking about abortion, whatever loopholes Stellonia points out. Nearly all passed World Assembly legislation is written to apply to humans or humanoids. It is not necessary to point out in each resolution that certain parts of it may not apply to other species. I also agree with Phydios' criticism of Stellonia's reasoning regarding his "strategic" no vote. I quote Phydios here: "Even if [RF] did nothing that earlier resolutions didn't, it would still stand in the way of a near-total ban on abortion." Furthermore, Stellonia's calling into question of Phydios' motives is speculation that cannot be proved or disproved; Phydios' allegedly shady motives may have an impact on residents' perception of him, but it will not have an impact on this case. On the other hand, I agree with Stellonia that Ostryt v. Culture of Life (Justice Court, 10 December 2014, unpublished) is irrelevant, or at least, it offers nothing to add to Phydios' arguments. I also disagree with Phydios that "voting against the repeal (i.e., opposition and removal) of a pro-abortion resolution has the same effect as supporting it; in either case, one desires it to be international law." Voting against the repeal seems bizarre and unproductive to the pro-life cause to me, but that's my perception (as well as Phydios' perception). Our regional law requires us to be against elective abortion in all or most cases; it does not specify exactly how we go about our opposition in legislative terms. Phydios has cast much doubt on Stellonia's reasoning for voting against the repeal of RF, but he has not proven that Stellonia went against regional law by doing so. If this had been a case of Stellonia voting for the original RF to be passed, I might be forced to agree with Phydios and order Stellonia's citizenship revoked.
The Justice Court finds Stellonia NOT GUILTY as charged.
